A U.S. Senator and congressmen sent a second letter to U.S. Customs and Border Protection Commissioner R. Gil Kerlikowske on Friday requesting for him to classify the death of Border Patrol agent Javier Vega Jr. as a line of duty fatality.

The request was made to ensure that Vega’s family receives the corresponding benefits granted after a public safety officer is killed in the line of duty.

Vega was killed in 2014 after being held at gunpoint by two unauthorized immigrants while fishing with his family in Willacy County.

U.S. Senator John Cornyn (R-TX), U.S. Representative Filemon Vela (D, TX-34), U.S. Representative Michael McCaul (R, TX-10) and U.S. Representative John Carter (R, TX-31) wrote that a line of duty fatality is appropriate “because he was responding to a clear violation of law,” according to the letter.

“Here we are a year later writing another letter,” said Vela. “It’s astonishing to me that we cannot get these people in Washington to do the right thing.”
