BROWNSVILLE, Texas – An appeal for a Valley man on death row has been denied by the Texas Court of Criminal Appeals.
In April 1999 Ruben Gutierrez was convicted of the 1998 murder of 85-year-old Escolastica Harrison of Brownsville. One month later a Cameron County jury sentenced him to death. After several appeals Gutierrez was scheduled to be executed in October 2019, but due to a clerical error Gutierrez was granted a stay and was asking for a DNA test. Today the court ruling he did not meet the requirements and have lifted the stay of execution.
The Cameron County District Attorney’s office says they will be in court on Feb. 27 to reschedule the execution date.
