A 22-year-old was arrested Tuesday night for causing a rollover accident that injured a child, and put his own daughters life at risk.

A Primera police officer responded to a rollover accident at 9 p.m. in a ditch on Cragon Road.

When the officer arrived, he saw a gray Expedition laying on its roof top.

Roberto Rios Jr. got out of the car and identified himself as the driver of the car.

Rios’ young daughter was in the Expedition with him at the time of the accident.

The officer reported that as Rios talked, he could smell alcohol emitting from the 22-year-old’s breath.

Another officer at the scene advised that a 15-year-old had been struck by the vehicle south of the accident.

Medical Services were then called to treat his right shoulder injuries.

A Texas Department of Public Safety (DPS) trooper was called to the scene to conduct a field sobriety test for the driver.

Rios was placed under arrest and taken to Harlingen Medical Center for a blood drawn sample.

He was charged with intoxication assault, a third degree felony.

Rios was also charged with Driving While Intoxicated with a child under 15.

His bond’s totaled $55,000.
