A candidate for District 40 state representative announced he is filing a complaint with the Texas Ethics Commission Wednesday.

Over the past week, flyers were distributed through the U.S. Postal Service in Edinburg claiming district 40 candidate, Robert Peña Jr., was guilty of bad business practices involving home foreclosures more than a year ago.

Pena is calling the propaganda a malicious attack filled with half truths.

No name or political disclaimer is displayed on the flyer which is a violation of political campaign rules.

"I ask the public to look at the cowardness and ask yourselves, is this the type of leader you want to for District 40?  They should be ashamed they cannot lead by example and be concerned for the ethical violations they find themselves in,” Peña said in the Wednesday press conference.

Peña is calling upon his opponents who did not endorse the propaganda to denounce such tactics.

This is not the first time Peña has served in public office.  He was first elected to the Edinburg ISD board in 2007.
