Action 4 News has obtained a copy of a pre-suit petition document allegeding the rape and sexual assault of a teen, and a possible cover-up which allegedly happened at a Wendy’s Restaurant in Brownsville.
The teen victim's lawyer, Robert Collins, said that on Wednesday he filed the pre-suit discovery with the Cameron County District Attorney's office.
He said the petition asks that those accused, provide sworn statements in regards to the allegations.
Collins, a South Padre Island based attorney, only identified the victim as "Jane Doe," and said she is 16-years-old.
Collins said the 16-year-old girl was raped and "tortured" while working at the Wendy’s Restaurant located at the 2300 block of Boca Chica Boulevard, for over a year.
Collins also said 45-year-old Carlos Castillo, a supervisor or manager at Wendy’s, confessed to the crime.
Brownsville Police first arrested Castillo in October 2011 on charges of sexual assault of a minor.
Collins said paragraph 11 on page 3 of the petition refers to Castillo, which states, "Petitioner seeks to obtain this pre-suit discovery to investigate a potential claim or claims by petitioner as a result of a series of rapes and sexual assaults against petitioner Jane Doe."
Exelco Inc. is named in the petition as the area's Wendy’s employer for several of the accused employees.
The corporation's attorney, Mike Holland, told Action 4 News they are aware of the allegations and they are investigating, however, he adds that at this time they are just allegations.
Collins said they want a thorough investigation and are looking to file civil and criminal suits.
"We know that there have been several instances of rapes and sexual torture by managers, and supervisors of Wendy’s and we're going to take the discovery and get the sworn statements and get to the bottom of that," Collins said. "We know that our government has told us, our supreme court has told us, that corporations are people and it's now time for the criminal laws to be applied to corporations like they are to people."
Collins also told Action 4 News that Castillo is now being linked to several other cases, but the details could not be released.
Collins added that the district attorney will take the case before a grand jury soon, and more victims are expected to come forward.
