Police sergeant order "take him out" for Cummings Middle School student

MCALLEN, TEXAS (AP) -- A report released by the state attorney general says a police sergeant gave the order to "take him out" when an armed South Texas student turned toward another student in a middle school hallway in January.

The report filed by Brownsville police says 15-year-old Jaime Gonzalez was holding a realistic-looking pellet gun when he turned toward a student trapped between him and officers.

Gonzalez was fatally shot in the abdomen and chest inside Cummings Middle School.

custodial death report must be filed with the Texas attorney general's office when someone dies in police custody. It was first reported by The Brownsville Herald.

The report reflects earlier police statements that Gonzalez pointed the pellet gun at them, but also raises the possibility that he fired at officers.
