A Brownsville mother is devastated after the supposed sexual molester of her 14 year old daughter was only given probation.
The victim's mother, who spoke on condition of anonymity, said after months of waiting, she believes justice was not served.
"All he is getting is probation. He is going to register as a sex offender and wear an ankle monitoring device but I still don't think it's enough. I wanted him to serve jail time.”
Today the 445th District Court Judge Rolando Olvera sentenced 19-year-old Andres Noyola of Brownsville to 10 years of deferred adjudication for sexual assault of a child.
Noyola will also have to relocate out of the neighborhood he shared with the victim's family.
The mother said she is also upset with the District Attorney’s office.
Despite weekly calls for the past months to the DA Office, they never informed her that an agreement had already been reached.
"That's what the DA had agreed to without letting me know they had made this arrangement. If I wouldn't have called the yesterday to find out when was the court date, I wouldn't have known to show up to court today.”
Alexis Clynes, who serves as the Public Information Officer for the Cameron County District Attorney says in a statement that the victim's parents were present at both hearings and in agreement with defendant being sentenced to probation.
She also says the parents refused to allow their daughter to testify at trial, which contributed to the plea.
This mother says she did not want to put her daughter on the stand, forcing her to relive a nightmare.
For now the mother said she is turning to a counselor for advice about how help her daughter work through this traumatic experience.
