It's been an emotional morning in the 398th State District Court as jurors decide if they will give an Alton man the death penalty.

Jurors are spending the day hearing testimony for the sentencing of Roberto Aguirre Rojas.

The 45-year-old Alton man was supposed to go on trial on Monday but pleaded guilty to killing four family members back in December 2008.

Rojas was accused of multiple counts of capital murder following the slaying of three small children, his mother-in-law and the attempted murder of his estranged wife.

The Alton man faces life in prison or the death penalty.

Jurors spent Tuesday morning hearing testimony from law enforcement officials and looking at bloody crime scene photos of his slain children.

The young victims Osiel Rojas, Sylvestre Garza and Mauro Garza ranged in ages from 3 to 8 years old.

Prosecutors also showed jurors blood-soaked clothes belonging to 3-year-old Osiel.

The massacre happened northwest of Alton back in December 2008.

Rojas told investigators that he lost it because of he and his wife were having marital problems.

His wife Amelia Rojas was the sole survivor of the attack.

She now goes by her maiden name Amelia Flores and has become an activist and speaker about domestic violence.
