Zeke Silva is off the ballot for Brownsville City Commissioner District 2 yet again, leaving Charlie Atkinson to run unopposed.

A letter from the Office of the City Secretary Estela Von Hatten Silva failed to provide evidence of a pardon or judicial action restoring his rights for a felony conviction that prevents him under the Texas Election Code to run.

The letter also stated that city officials consulted with the City Attorney, the Cameron County District Attorney, and the Texas Secretary of State before reaching a conclusion.

Action 4 News spoke to Silva over the phone Tuesday evening. He said this latest move was a "complete injustice.”

“They [Mark Sossi, Charlie Atkinson, Estella Von Hatten] make the rules as they go along. I feel sorry for the constituents of District 2. They are going to be stuck with Charlie Atkinson who has done nothing for the district,” said Silva. 

Silva went on to say that he plans to file a lawsuit against the City of Brownsville.
