Controversial Brownsville City Commission candidate Esequiel 'Zeke' Silva is off the ballot.

Texas Secretary of State Hope Andrade ruled Silva as an ineligible candidate in the race due to a DWI conviction.

Silva told Action 4 News that he is not giving up.

The Brownsville man said he is looking into becoming a write-in candidate on the ballot.

Silva had been seeking to unseat District 2 City Commissioner Charlie Atkinson.

Action 4 News archives show that Atkinson had a previous arrest for reckless driving back in February 2006 and another arrest for DWI in November 2007.

Neither arrest resulted in a conviction for Atkinson.
