Police said the two were smoking marijuana

Two San Benito High School football players are facing fines and criminal charges after being arrested for being under the influence of marijuana.

San Benito Police confirmed 17-year-old David Rodriguez and 18-year-old Andrew Garza were arrested on public intoxication charges early Thursday morning on the 1400 block of Combes.

Police apparently spotted the teens near Falagant Park with a strong odor of marijuana coming from their breath and clothing.

Although the officers did not find any marijuana on them, both subjects were still arrested for being under the influence of marijuana.

Under Texas state law, public Iintoxication is a Class C Misdemeanor punishable up to a $500 dollar fine.

Police said the teens were students at San Benito High School but couldn’t confirm that Rodriguez and Garza were members of the football team.

According to the team’s roster, it lists two players with matching names, Rodriguez as Quarterback and Garza as Defensive Back.

Investigators said they were each given a $300 dollar fine each.

San Benito Consolidated Independent School District released a statement about the case to reporters:

" San Benito Consolidated Independent School District  officials received reports that students were allegedly involved in an incident during non-school activity outside of the school day. "

"School administration has reviewed the matter in question and has taken appropriate action on the students involved in the incident. In keeping with San Benito CISD's strict adherence to students and families' right to privacy, the district is not allowed to comment about individual allegations or incidents."
