A San Benito mom says she's not giving up and wants her son's school, Ed Downs Elementary in San Benito to be held accountable for what she claims happened to her 10-year-old son while at school.

She tells Action 4 News, "I feel like I'm getting the run around I feel like they're trying to hide the truth I feel like they're trying to call my son a liar."

This mom says her son who is new to the school to begin with got in trouble for talking at lunch last Thursday.

She says the next day a teacher's aid grabbed her son by the arm and placed him in the back of the school lunch line. 

She showed  Action 4 News a picture of her son’s bruised are after the alleged incident.

She says, "If my son does something wrong you send me a note and you can discipline him by any other form, than putting your hands on him and leaving a bruise."

This mom  also paid a visit to the school district Friday to pick up a school police report of the alleged incident.  But she says there was a big problem with the report when she took it to San Benito city officials.

“After I spoke with the City Manager and the Chief of Police for the city they basically said this does not look like an official police report it's incomplete their is no heading on the report it's incomplete only one page statements not attached and it was given to me by the Chief of Police from the San Benito Independent School District," she said.

This mom says she's going to standup for her son and make sure nothing like this ever happens again.

She tells Action 4 News, “Something will be done and I am seeking legal action I'm seeking legal advice and I have support and I do have people out there that do  believe my son."

This mom says she's already contacted Child Protective Services. She also says she will go back to the school district Monday and ask for a complete school police report and will continue to take action.

San Benito CISD sent us a statement Thursday night saying in part, the school's surveillance video didn't show any evidence of wrongdoing by the paraprofessional in question. 

Also the school's assistant principal was present at the time of the alleged incident and didn't witness any wrongdoing.
