Deported baby case heads back to court

MCALLEN, TEXAS (AP) -- An appeals court will rehear the case of a Texas woman who sued the government after the Border Patrol sent her 1-year-old daughter to Mexico with the baby's deported father in 2003.

The 5th U.S. Circuit Court of Appeals in New Orleans has scheduled January oral arguments in Monica Castro's case against the U.S. government.

Last February, a three-judge 5th Circuit panel ordered, in a split decision, that the case return to federal district court in Corpus Christi. That's where it was originally dismissed.

The appeals court granted the government petition for a rehearing on Friday.
