Competency decision for Rubio remains pending

Accused child killer John Allen Rubio was back  in court this morning.

State District Judge Arturo Nelson held a hearing to determine if Rubio is competent to stand trial for the March 2005 murders of his three children.

Action 4 News had the only news cameras in the courtroom on Monday morning.

Defense attorneys told Judge Nelson that they were not ready with psychiatric evalutions prompting a reaction from prosecutors.

Judge Nelson postponed Rubio's competency hearing until July 1st.

Rubio is expected to go to trial in September.

The Brownsville man is accused of killing his son and two stepdaughters in March 2005.

His wife Angela Camacho is serving a life sentence for her role in their deaths.

Rubio was given the death penalty during his first trial but a higher court ruled he need a new trial.
