It was an emotional day in court for the murder case of Albert Trevino, allegedly killed by a former Edinburg mayor's son, Carlos Ochoa.

The jury heard an emotional testimony from the primary witness in the case Laura de la Cruz, Ochoa’s former girlfriend.
"I remember running out of things to say. I knew I wanted to keep on talking because I knew if I stopped talking that would put me in a bad situation,” Ochoa said. “I didn't know what would happen so I kept talking."

De la Cruz shared what she remembered from the night of September 17, 2011, stating Ochoa was intoxicated, had smoked pot and had taken some sort of medication.

The defense argued Ochoa was not in his right mind.

De la Cruz shared that after Ochoa shot and killed Trevino with a single shot, she feared her life as he choked her.

"I was telling him, ‘I love you I love you, stop. What are you doing?’  And it would seem like when I would speak he would stop to listen then he would continue to push and push and I got to the point where I couldn't breathe.  I was gasping,” de la Cruz said.

It all stopped when the cops rang the doorbell, answering the call of concerned neighbors.

More witnesses will be called to testify throughout the week in the 430th district court.
