Just minutes out of sight, while shopping at a Wal-Mart store on Saturday, Graciela Dorado alleges a man inappropriately touched her daughter.
The incident happened at Wal-Mart off Nolana Avenue in McAllen.
The 10-year-old went to another aisle.
“She just told me nervous, crying that a man had just grabbed her, touched her from her butt, squeezing her little butt,” Dorado said.
Her motherly instincts kicked in.
She went searching for the man after her daughter spotted him, mom yelled out for Wal-Mart employees to stop him.
29 year-old Jose Fernando Castilleja was arrested but not for what he allegedly did to the child.
He was arrested for violation of outstanding warrants.
“I told them you must have kids, grandkids or nephews that you wouldn't want to go through what I went through with my daughter, it’s a very ugly experience,” she said.
Castilleja was let out hours later.
Dorado said even though he didn't cause physical damage he still violated – the 10-year-olds rights and innocence.
“What if he would have just took her or done something else there at Wal-Mart,” she said.
She wants police to file indecency with a child charges against him.
Action 4 News spoke to McAllen Police and they said Castilleja is currently charged with assault.
Lt. Morales said that’s the appropriate charge and unless other evidence develops other charges could be filed.
For now Castilleja is charged with assault, a charge that Dorado says is not enough.
