MCALLEN, TEXAS (AP) -- A South Texas prosecutor is scheduled to meet with state police officials investigating the deaths of two Guatemalan immigrants who were hiding under a cover in a truck bed when a trooper in a helicopter tried to disable the fleeing vehicle by opening fire.

Hidalgo County District Attorney Rene Guerra says he's scheduled to meet with Texas Department of Public Safety officials Wednesday.

On Oct. 25, a DPS helicopter joined in the pursuit of a pickup truck near La Joya that was suspected of carrying a covered drug load.

Two illegal immigrants were killed and a third person was injured after the trooper opened fire.

The county is currently prosecuting a juvenile driver of a failed immigrant smuggling operation in Palmview in April in which nine immigrants died.
