Hidalgo County family sues three bars for DWI death

Luis Hernandez would have graduated in May.

His mother, Maria Alvarez, said he wanted to become a doctor and take care of his family.

Unfortunately those plans were brought to a halt when Jose Madrid Slammed into the car Luis was riding in---that impact killed him.

Court records showed that Madrid was intoxicated at the time of the crash.

He was convicted of intoxicated manslaughter in September and still has not been sentenced.

“It was my son…tomorrow it could be someone else,” Maria said.

Maria and the family of Jose Balderas ,the other victim in the crash, are suing Madrid and three establishments for selling alcohol to Madrid who was underage. 

"There are people that are being hurt and lives that are being lost as a result of the companies and businesses and people that feed the impulses to drink and over drink in the Valley," attorney John Escamilla told Action 4 News.

He added, if they do not stand up to these businesses—incidents like the one that happened a year ago will continue to happen.

"The only thing that's going to make them stand up and take notice is when they're held accountable in the a court of law and that's what we're trying to do with this case."
