Hidalgo County Sheriff Lupe Trevino said Dustin Wesley Cook admitted he knew Harwell Middle School was in his line of fire.
"An adult has to be responsible for his actions...you have to act responsible,” Sheriff Trevino said. “That's the thing—he just didn't."
Cook was charged with aggravated assault—it is a charge that could land him in jail for two to 20 years.
"This was not an act to commit harm—but an act of recklessness," Trevino said.
Cook was charged with aggravated assault and given a $100,000 bond.
Cook’s attorney, Michael Guerra, told Action 4 News when the evidence comes out it will show that his client has no criminal responsibility in the shooting.
As for both of the young victims—13-year-old Nicholas Tijerina and Edson Amaro still have a long recovery road ahead of them.
