'Baby Destiny' dies days after being removed form life support

A Hidalgo County baby at the center of child abuse case has died just two days after being removed from life support.

Hidalgo County Sheriff's Office deputies reported that Baby Destiny Barrientos died on Sunday.

The baby girl had spent more than seven months on life support.

The girl was only 10 months old at the time of a fatal beating.

Baby Destiny was removed from life support late Friday morning and had been breathing on her own but passed away Sunday.

The girl's mother Veronica Solis received 10 years probation in an injury to a child case back in May.

Solis' boyfriend got five years prison for the same case back in February.

Hidalgo County Sheriff Lupe Treviño said the couple cannot be charged with murder in the case even though Baby Destiny later died.

Sheriff Treviño relesaed the following statement in the case:

"As we all know, a person can not be tried twice for the same offense.  The people charged in this case have been arrested, tried, and convicted.  The decision to proceed was mutually agreed by the D.A and the Sheriff.  This decision was based on the prognosis given by three medical authorities.  It was a very difficult decision that had to be made, but it was made with the best information available.  It would have been impractical for the criminal justice system to delay judicial action to see if the child died, knowing the medical prognosis.  According to the doctor's opinions the child might have survived a unknown number of years”.
