Joaquin is a Pre-K student at Morningside Elementary in Brownsville.

His mother Helen Garza told Action 4 he's usually a ball of energy thats why when he came home from school about a week ago with a big red mark on his nose she wasn’t too worried.

“You know boys are boys,” said Garza.  “I never bother to ask him cause you know he's going to bump his nose his going to get scratches bumps and everything. And he kept coming home like that.”

Garza said it was then she began to worry and questioned her son.

The 4 year old finally confessed and told her what had happened.

Little Joaquin explained to our cameras that his Pre-K teacher had allegedly grabbed him with force leaving the mark.

The worried mother said she took matters straight to school administrators and got this, “It seemed like she was trying to put words in his mouth because she's like are you sure...he was just playing right...he was just playing with your nose right?”

Garza said her son being 4 years old was persuaded to agreed and felt like nothing was really accomplished.

Instead, Garza explained, the principal pointed her son as the problem.

“I feel like they're saying it's ok that he did this to your child because your child acts like this.”

As a result, Garza told Action 4 the 4-year-old was moved to another class and now she can’t stop getting notes from his new teacher.

The Brownsville mother feels her son is getting punished and will be afraid to tell the truth from now on.

Garza said regardless of how her son acts she doesn’t feel it’s appropriate for someone to put their hands on him.

We tried contacting BISD on this matter and their spokesperson Drue Brown said, "I can confirm that there is an investigation into some allegations made at Morningside Elementary School…However I can offer no further comment since it is a personnel matter.”
