Action 4 News has learned that San Benito's Assistant Police Chief Arnold Garcia has been suspended amid a scandal involving an incomplete drug test.

San Benito Human Resource Director Art Rodriguez told Action 4 News that Garcia is still employed but refused to comment further calling it a personnel matter.

Sources told Action 4 News that Garcia failed to properly take a random drug test.

Action 4 News reviewed city employment policies, which state all city employees are required to comply with such tests or face termination.

Rank and file police officers who've contacted Action 4 News said they are extremely upset.

They said they would have been fired on the spot for refusing to complete a drug test and are calling it "preferential treatment" for Garcia.

The officers said any other city employee in San Benito would've been terminated immediately.
