A state district judge is expected to announce his findings in a voter fraud case filed in Cameron County.
Judge Rudy Delgado will preside in a special hearing for the case in the 138th state District Court at 3 p.m. Wednesday.
The Hidalgo County-based judge is expected to decide the outcome of the Democratic Party's primary runoff for the Cameron County Comissioner Precinct 2 seat.
Candidate Ruben Peña lost by 49 votes to rival Ernie Hernandez during April Democratic Primary runoff race.
Both men were vying for the Democratic Party’s nomination for the seat.
Hernandez received 2,159 votes or 51 percent of ballot while Peña got 2,110 votes or 49 percent of the ballot.
Peña filed a lawsuit in to impound mail-in ballots and a temporary restraining order against Cameron County Elections Administrator Roger Ortiz.
The Precinct 2 Commissioner candidate alleged that mail-in ballot numbers were “blatantly discrepant” with regular in-person voting.
Peña claims he won the regular vote but lost due to the mail-in ballots.
