'Whistleblower' suit in City of Edinburg

A lawsuit has been filed against the City of Edinburg for improper termination under “The Texas Whistleblower Act.”
               
The former Director of Human Resources, Arnold Rodriguez, was abruptly terminated in November of 2009. 

City Manager, Ramiro Garza, Jr. reportedly told the Plaintiff that he wanted to go a "different direction.” 
           
Rodriguez was a former “at-will” employee.  His Attorney, David Joe, said this was a clear case of “wrongful termination” based on his client’s investigation into alleged “labor” violations.
           
According to the Plaintiff’s original petition, Rodriguez had been in contact with the U.S. Department of Labor over Family Medical Leave Act and Fair Labor Standards Act violations by the City of Edinburg. 
           
The Plaintiff stated he was open about this to both his former boss and the newly appointed city manager to prevent violations of employees’ rights and to reduce litigation.
           
Ramiro Garza, Jr. terminated Rodriguez during his first week on the job, according to the lawsuit.

The City of Edinburg’s public information officer said the city does not comment on pending litigation
