An appeals court has upheld the conviction of Hidalgo County Constable Eduardo “Walo” Bazan.
Judge Nelda V. Rodriguez with the Texas 13th Court of Appeals handed down her opinion in the case Tuesday.
The Precinct 5 constable was accused and convicted in a felony theft case.
Bazan filed an appeal and won re-election in November 2008.
Hidalgo County commissioners suspended Bazan pending the outcome of the case.
Under state law, the upheld conviction would cause Bazan to lose his peace officer’s license making him ineligible to serve as constable.
Bazan could not immediately be reached for comment.
