Former mariachi director charged for sexual relationship with student

Former Edcouch-Elsa Independent School District Mariachi director and teacher's aide Homero Gutierrez is now facing criminal charges.

Elsa police arrested and charged Gutierrez on Thursday morning and charged him with having a sexual relationship with a female student.

Police chief Primitivo Rodriguez told Action 4 News Gutierrez was charged with one count of inappropriate relationship between an educator and student.

An investigation was launched after the suspected victim's parent's came forward claiming the teacher was having sex with their 16-year-old daughter at various places including on the school campus.

"She was a child," the woman said over the phone. "She was 16. He was 35."

The family turned to the school district after learning about the alleged, ongoing sexual relationship.

Interim Superintendent Dr. Richard Rivera at that time told Action 4 News, Gutierrez, who was also a teacher's aide, resigned after the allegations surfaced.

Action 4 News did contact Dr. Rivera after learning about the arrest, but he was not aware Gutierrez has been arrested.

He did state the school district is still actively investigating, and they have also alerted the Texas Education Agency.

Gutierrez was transferred to the Hidalgo County Jail where he is expected to post bond.
