The allegations against a former mariachi director at the Edcouch-Elsa Independent School District span over the course of two years.

A relative of the student he's accused of having an improper relationship with claimed the victim was 16 when the two first had sex while at school.

"She was a child," the woman said over the phone.  "She was 16.  He was 35."

Her family recently turned to the school district after learning about the alleged, ongoing sexual relationship.

Interim Superintendent Dr. Richard Rivera says the former director in question, who was also a teacher's aide, resigned after the allegations surfaced.

The district then turned the case over to the Elsa Police Department, according to Dr. Rivera.

Chief Primitivo Rodriguez expects the criminal investigation to wrap up this week.

His detectives are still trying to get a statement from the former mariachi director who's being called a person of interest.

The chief says the man in question has retained an attorney, although he could not provide Action 4 News with any specific name.

"The mother and her daughter came into the police department to inform us about what has happened," Chief Rodriguez said.  "Of course, we can't have that at schools or anywhere else."

The mother told police how the sexual encounters would happen at the district's Fine Arts building. 

She told them her daughter would often be late to class or last to leave for the day.

The behavior seemed strange and ultimately led to her family questioning whether the two may have been romantically involved.

They would later learn how he would allegedly use her feelings towards him to ensure the sex at school would remain a secret, according to a relative who did not want to be identified.

"She told me that if she would tell... if this would ever get out or if anybody would ever know about this... ‘I would kill myself,’" the relative said over the phone.

Now they just want justice.

Several attempts to reach the former mariachi director for a comment were unsuccessful.

He faces a possible charge of improper relationship between an educator and student, even if it’s found the alleged sexual relationship was consensual.

Charges could be upgraded if further evidence shows the sexual relationship started when the student was 16.
