Fate of teen in ICE agent shooting remains undecided

EDINBURG, TEXAS (AP) -- A South Texas judge says he'll decide next week whether a 17-year-old boy charged with attempted murder will stand trial as a juvenile or an adult.

The boy, whose name is withheld because he is a juvenile, was age 16 on July 3 when authorities say he shot at a fleeing vehicle driven by a federal agent.

Special Agent Kelton Harrison of the U.S. Immigration and Customs Enforcement was conducting surveillance near the boy's home in Hargill when, according to prosecutors, a pickup driven by the boy's father, Pedro Alvarado, approached. Gunfire erupted from the truck as Harrison was chased at speeds of 100 mph and wounded once in the back.

Authorities say the boy and his 18-year-old brother admitted to firing as their father drove.
