A former customs officers is expected to appear before a federal judge on Monday afternoon where he's asking for probation instead of jail time for a gun-buying scheme.
Manuel Eduardo Peña is expected to appear for sentencing before U.S. District Court Judge Hilda Tagle in Brownsville on Monday afternoon.
A federal jury found Peña guilty back in August.
But court records show that Peña is seeking probation for the illegal gun-buying scheme.
Defense attorney Ernesto Gamez filed a motion saying that Peña is the sole provider of three children from his first marriage and a 3-year-old boy from his second marriage.
Gamez argued that Peña had numerous commendations for drug seizures and other acts during his career as a U.S. Customs and Border Protection (CBP) officer.
Court records show that prosecutors are against giving Peña probation.
