A Harlingen man is out of the hospital and now facing criminal charges for murdering his estranged wife, her unborn child and a man inside her home.

Harlingen police charged 34-year-old Omar Montemayor on three counts of murder on Monday morning.

Montemayor is accused in the September 28th deaths of 29-year-old Sarah Maxwell Montemayor and 28-year-old Devan Leroy Haynes.

Investigators told Action 4 News that an autopsy revealed that Montemayor's estranged wife was five to eight weeks pregnant at the time of her death prompting a third murder charge.

Montemayor allegedly turned the gun on himself at the time of the crime injuring himself with a gunshot wound to the head.

The Harlingen man spent weeks in the hospital but recovered from his injuries prompting police to file charges.

Montemayor remains in custody at the Cameron County Jail under $6 million dollars in bonds.
