A San Benito man who admitted to being the "middleman" in the Abel Limas "cash for court favors" scandal has filed a motion to withdraw from his plea agreement.

Jose Manuel Longoria was scheduled to appear for sentencing before U.S. District Court Judge Andrew S. Hanen on Tuesday morning.

Longoria's defense attorney Everardo Garcia filed a motion to withdraw his client from his November 21st plea agreement with prosecutors.

According to the motion, Longoria was going to receive an "upward departure" or heavier sentence for his role in the case.

Garcia could not immediately be reached for comment but the motion states they oppose a heavier sentence because Longoria's guilty plea allowed authorities to "allocate their resources more efficiently."

The motion states that Longoria is not changing his guilty plea but rather just wants out of the plea agreement.

Longoria's decision comes one day after Brownsville attorney Ray Marchan was found guilty on seven charges related to the court favors scandal.

Court records show a sealed event was filed with the court on Tuesday morning.
