A head baseball coach is fighting to have his coaching duties reinstated, while another is fighting to get his job back.

On Monday, Action 4 News learned Sergio Rubio was suspended and assistant coach George Franco was fired.

Administrators at Edcouch-Elsa ISD claim they have evidence to prove they did not properly supervise teammates.

The incident allegedly resulted in an alleged sexual act between two students to continue while aboard a school bus.

Edcouch-Elsa ISD attorney Gustavo Acevedo says a video shows sex acts between a female student trainer and underage male student player.

Acevedo says the video shows Franco not only watching the students engage in lewd behavior but draw attention to it.

Action 4 News spoke to Rubio’s attorney John Shergold, who says his client is “100 percent innocent.”

 “I will not be trying the case on Channel 4 News and will not be commenting on employee issues,” Shergold added.

When asked about the video tape evidence against Rubio, Shergold said he could not comment, because he had not seen it yet.

According to school district officials, Rubio was allegedly asleep at the time of the incident.

Acevedo says the video shows Franco woke him up by kicking Rubio 14 times, but that Rubio fell back to sleep.

Rubio remains on the job but could be fired after the school board reviews the case.

An attorney for Franco has not returned our calls but school district officials said he’s appealing his termination.
