Sentencing postponed in Alton DWI fatality

Jose Pena Madrid stood stone-faced as he listened to Judge Noe Gonzalez speak.

But Judge Gonzalez did not sentence Madrid—he postponed it until January 18th.

It was a decision that left Luis Hernandez’s mother, Maria Elena, upset.

 “We continue to wait for justice for the man who killed our son,” Maria sobbed. “We’re waiting for justice for our son’s life.”

Maria told Action 4 News this has been a long process for her and her family.

She said they cannot move on until this case is finally closed.

“It seems like it just happened yesterday,” Maria said. “Our family is starting out this new year incomplete.”

The accident happened nearly one year ago.

On January 26, 2011 Luis Hernandez and his friend Jose Balderas were headed to the Alton Flea Market—where they both worked.

As they crossed the intersection of 5 Mile Line and Los Ebanos Road, Jose Madrid slammed into them.

The impact killed Luis and severely injured Jose.

Madrid is due back in court on January 18th—at that time friends and family of Luis, Jose, and Madrid will have a chance to speak on their behalf.
