Cameron County Pct. 4 Constable Robert Lopez uses his work cell for a lot of things but viewing pornographic material is not one of them.
"I want people to know I don't deal with pornographic stuff on my phone... That is wrong... This is a county phone... And I would never," he said.
That's why he filed a police report for harassment over explicit images texted to him last week.
The series of photos best described as transgendered fetish porn start off tame.
The first shot is what appears to be a blond female flashing a sultry stare.
The rest are way too graphic in nature.
Primera Police Chief Joe Rodriguez admits he inadvertently texted the scandalous material from his personal phone.
Reporter: "Why did you send those pornographic images?"
Chief: "I explained to him [constable] that it was accident."
Reporter: "So you did send the messages?"
Chief: "Accidentally."
Reporter: "So who were you trying to send them to?"
Chief: "To a cousin of mine."
Robert doesn't buy the excuse as evident by a text message he sent in response to the chief's that reads: "This is a government phone and do not appreciate this... Will make a report."
He believes, Chief Rodriguez, texted the cell smut to try and make him look bad if someone should ever file an open records request on his government issued phone.
The two are running against each other for constable in 2012.
The chief makes the same claim about the constable's attempt to humiliate him.
"All this is... It's a political deal Ryan... Cause I'm running against him," Chief Rodriguez said over the phone.
Back in 2007, Chief Rodriguez was terminated from the Rio Hondo ISD.
It was the result of an investigation over adult web content searches he allegedly made from school computers as a district cop.
Chief Rodriguez would not comment on his termination.
The constable says it proves a pattern of inappropriate behavior.
"He's an adult... he's a chief of police in Primera... he should be more responsible... more respectable when it comes to the public."
It's unclear if any criminal charges will be filed against Chief Rodriguez.
