John Allen Rubio gets the death penalty

A Hidalgo County jury has reached a verdict and recommended the death penalty for convicted child killer John Allen Rubio.

Jurors in the case started deliberations in the capital murder case this morning.

"I'm sorry it all had to come to his," Rubio said in open court.

Jurors convicted Rubio for the death of three children belong to him and his common-law wife Angela Camacho back in March 2003.

Testimony for the sentencing phase of Rubio's trial started on Monday and ended with closing arguments this morning.

Jurors took about four hours to make their decision.

This the second Rubio has been sentenced to death.

The Brownsville man was sentenced to death during his first trial but a higher court ordered a new trial.

Rubio's second trial in the case was moved from Cameron County to Hidalgo County.

Action 4 News will have the latest from the courtroom as we await the jury's decision.
