Hurricane Dolly lawsuit deadline approaching

Many Texas homeowners and businesses are still fighting with their insurance carriers over Hurricane Dolly related property damages.

They may need to take legal action, or lose their right to sue.

2 years later, those affected by Hurricane Dolly who had problems collecting from their insurance agencies are suing before the deadline.

“Breach of contract, or whether they were not able to fix their homes or the funding to be able to repair their homes," said Cameron County District Clerk Aurora De La Garza.

According to Texas Law a hurricane claim needs to be filed before the statute of limitations runs out which is 2 years because of that lawsuits are rushing in to De La Garza’s office.

 “We have been inundated with lawsuits between yesterday and today we might of had maybe like 175 and we’ve probably had about 300 filled in the last couple of weeks," said De La Garza.

Court records revealed insurance agencies being sued include Texas Windstorm, Loya Insurance and State Farm.

For now De La Garza’s office is working hard to beat the clock and make sure every lawsuit before the statute of limitation runs out.

The deadline to file a suit is scheduled for this Sunday July 25th but because the courts are closed they will extend it to Monday.
