Wrongful death suit filed against Border Patrol

The family of a man killed by a Border Patrol unit while walking near the Pharr-Reynosa International Bridge has filed a wrongful death lawsuit.

Action 4 News first reported the death of Miguel Castillo Lopez back in December 2008.

An on-duty Border Patrol agent struck and killed Lopez while he was crossing a well-lit area of Military Highway near the Pharr bridge.

Lopez's family filed a federal lawsuit against Border Patrol agent Francisco Javier Longoria and the federal government late last week.

Longoria was driving a Border Patrol unit at the time of the accident.

The family claims that there is no sign that Longoria tried to avoid hitting Lopez and that the Border Patrol agent called his co-workers supervisors before calling 911.

The family is asking for medical, funeral and legal expenses among other damages.
